This policy explains how we collect, use, disclose and protect personal information through our website (tailorlaw.com), our contact and consultation forms, live chat, telephone and email. It follows the fair information principles of Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA): accountability, identifying purposes, consent, limiting collection, limiting use, disclosure and retention, accuracy, safeguards, openness, individual access, and challenging compliance.
We only use your information for the purposes described here, purposes you would reasonably expect, or as required or permitted by law.
By submitting a form, starting a chat, calling or emailing us, you consent to our collecting and using your information for the purposes above. You may withdraw your consent at any time by contacting our Privacy Officer, subject to legal or contractual restrictions and reasonable notice. If you withdraw consent, we may not be able to provide some services, and we may still keep information we are required to keep by law or professional rules.
Submitting a form, sending a chat message or email, or calling us does not create a lawyer–client relationship. Tailor Law only represents you after we have completed a conflict check and confirmed our retainer in writing. Please do not send confidential or sensitive details about your matter until we have confirmed that we represent you.
Information that clients share with us for the purpose of obtaining legal advice is protected by solicitor–client privilege and by our duty of confidentiality under the Law Society of Ontario Rules of Professional Conduct. These professional obligations apply in addition to this policy.
Before we can advise you, we must confirm that we do not act for, or have not acted for, anyone whose interests conflict with yours. To do this we record your name, the names of other parties (for example, your spouse or former partner) and a brief description of the matter, and we keep this information in our conflict-checking records even if we do not act for you.
We do not share your personal information except as described here:
Storage outside Canada. Some of our service providers store or process information outside Canada, including in the United States. Information stored outside Canada is subject to the laws of that country and may be accessible to its courts, law enforcement and national security authorities.
We do not sell, rent or trade your personal information.
We keep personal information only as long as needed for the purposes above, or as required by law and by Law Society of Ontario record-keeping obligations (for example, client file, trust accounting and client identification records). Conflict-check records are kept for as long as we need them to meet our professional duties. When information is no longer needed, we securely destroy or anonymize it.
We use physical, organizational and technical safeguards appropriate to the sensitivity of the information, including restricted access to our offices and systems, confidentiality obligations for our staff, password protection and encryption in transit (HTTPS). No method of transmission over the internet is completely secure, which is another reason we ask you not to send confidential details until we have confirmed our retainer.
You may ask to see the personal information we hold about you, ask how it has been used or disclosed, and ask us to correct anything that is inaccurate or incomplete. Please send your request in writing to our Privacy Officer. We will respond within 30 days, or tell you if we need more time as permitted by law. In some cases we may not be able to give access, for example where information is protected by solicitor–client privilege or contains information about other people; if so, we will tell you why.
