Unlike traditional litigators who prepare for war, a Collaborative Family Lawyer is specially trained to negotiate settlements outside of court. We sign a contract (The Participation Agreement) pledging not to litigate your case. Our role is to advocate for your interests respectfully while working as a team with your spouse's lawyer and financial neutrals to construct a durable agreement.

It can be, as you have lawyers present at all meetings. However, it is usually less expensive than litigation because you avoid court filings, motions, and trial prep. The collaborative process is designed to be efficient and focused on resolution.
Both lawyers MUST be collaboratively trained and sign the Participation Agreement. If your spouse's lawyer isn't trained, we cannot use the formal Collaborative Process. However, we can still help you explore other settlement options.
If the process breaks down, both lawyers must withdraw. You receive your file, and you must hire new litigation counsel for court. This creates a strong incentive to succeed and ensures everyone is fully committed to reaching an agreement.
