Do Mothers Automatically Get Custody?
No. The 'Tender Years Doctrine' (which automatically gave moms custody) was abolished years ago. Ontario law is strict: The Best Interests of the Child is the only test. However, courts DO value stability. If you have been the Primary Caregiver (handling doctor visits, school, bedtime) for the child's entire life, we argue that maintaining that stability is in the child's best interests, protecting you from sudden, disruptive 50/50 schedules.
