Family Law Paralegal Services in Ontario: What You Need to Know

Can a Paralegal Represent Me in Family Court?

In Ontario, standard paralegals cannot practice family law. However, as of recently, paralegals with a special Family Legal Services Provider (FLSP) license can assist with very limited, straightforward tasks, such as navigating court processes, filing joint/uncontested divorces, and updating basic child support based on T4 income. They are legally prohibited from handling child custody, parenting time, family violence cases, complex property division, or drafting separation agreements. If your case involves a dispute, you must hire a Family Lawyer.

FLSP Paralegals vs. Family Lawyers

The Law Society of Ontario strictly limits what paralegals can do to protect the public.

Uncontested Divorces

PARALEGAL APPROVED

An FLSP can help you file the paperwork for a joint or uncontested divorce where all issues (property, support) are already 100% resolved.

Basic Child Support Changes

PARALEGAL APPROVED

They can help you file a motion to change child support, but only if it is strictly based on the payor's T4 line 15000 income (no special expenses).

Child Custody & Parenting

LAWYER ONLY

Paralegals are completely barred from handling parenting disputes, decision-making responsibility, or cases involving family violence.

Property & Spousal Support

LAWYER ONLY

Paralegals cannot litigate complex property division, business valuations, or spousal support disputes.

The Separation Agreement Trap

Filing a document is not the same as writing one.

Filing an Agreement

Under the new rules, an authorized FLSP paralegal is allowed to take a completed, signed Domestic Contract (Separation Agreement) and physically file it with the court for enforcement.

Drafting an Agreement (Illegal for Paralegals)

An FLSP cannot draft, write, or amend a Separation Agreement. More importantly, they cannot provide Independent Legal Advice (ILA) on whether the agreement is fair or legally binding. Only a licensed Family Lawyer can do this.

Family Law Paralegal FAQs

Yes, their hourly rates are generally lower. However, because their scope is so limited, hiring a paralegal for a case that eventually becomes contested means you will have to pay a lawyer to take over anyway, costing you more in the long run. It's often more cost-effective to hire a family lawyer from the start if there's any possibility of dispute.
An FLSP can assist you in limited ways, but they cannot advocate for you in a complex dispute regarding custody or property. A lawyer is required for substantive negotiations. If the other party has a lawyer, you'll be at a significant disadvantage with only a paralegal.
You can verify their credentials on the Law Society of Ontario's public directory. A standard P1 paralegal license is not enough to practice family law. Look for the specific Family Legal Services Provider (FLSP) designation. Always verify credentials before hiring.
